Terms & Conditions

These Terms & Conditions govern purchases and use of products and services offered through AfterFire Test and AfterFireTest.com. By placing an order, submitting a sample, or using our services, you agree to these Terms.

1. About AfterFire Test

AfterFire Test provides consumers with access to laboratory testing of samples collected from their property for evidence of fire- and smoke-related particulate residue.

Our service may include customer sampling instructions, sample submission, prepaid shipping where included with the selected test, independent laboratory analysis, and delivery of laboratory findings.

AfterFire Test is not a property inspection company, remediation company, medical provider, insurance company, or governmental agency.

2. What You Are Purchasing

The testing included in your order is determined by the product and options you select at the time of purchase.

Your fire and smoke residue test evaluates submitted samples for ash, char, and soot. If you separately select Expanded Dust & Particle Profile — Add-On, the laboratory may also provide information regarding other materials present in the submitted sample.

When selected, Expanded Dust & Particle Profile — Add-On applies to every sample included in the test purchased.

The number of sample locations included in your purchase is stated on the applicable product page and order confirmation.

Laboratory findings apply to the sample or samples submitted and should not be interpreted as findings for areas that were not sampled.

3. Customer Sample Collection

AfterFire Test is designed to allow customers to collect their own samples using the instructions provided after purchase.

You are responsible for selecting the sampling location, following the provided collection instructions, accurately identifying and labeling each sample, providing accurate information, protecting the sample from contamination or damage, and submitting the correct number of samples for the test purchased.

Sample collection can affect laboratory findings. Failure to follow the collection instructions may result in an unrepresentative, contaminated, damaged, insufficient, or otherwise unsuitable sample.

4. Sample Selection and Representativeness

Conditions within a property can vary from room to room, surface to surface, and location to location.

A sample represents material collected from the selected location at the time of collection. The absence of a particular finding in one sample does not establish that the same condition is absent elsewhere in the property.

Likewise, the presence of material in a sample does not by itself establish its source, extent, duration, exposure level, or the condition of the property as a whole.

5. Laboratory Analysis

Samples may be analyzed by an independent third-party laboratory selected by AfterFire Test. Laboratory services are performed using the procedures applicable to the analysis ordered.

AfterFire Test may rely upon laboratory analytical findings when preparing or transmitting results to you and does not independently reproduce the laboratory analysis.

No analytical test can identify every possible substance, condition, source, or particle or eliminate all uncertainty.

6. Results and Reports

Results provide laboratory findings for the sample or samples submitted and should be interpreted in the context of the location and conditions where each sample was collected.

7. No Medical Advice

AfterFire Test does not provide medical advice, diagnosis, treatment recommendations, or individual health-risk assessments. Laboratory findings should not be used as a substitute for consultation with a physician or other qualified healthcare professional.

If you have symptoms or health concerns that you believe may be related to fire, smoke, indoor air, or environmental conditions, consult an appropriate healthcare professional.

8. No Property-Safety or Remediation Determination

AfterFire Test does not certify, warrant, or guarantee that a property is safe, clean, habitable, fully remediated, or free from fire- or smoke-related residue.

Testing one or more selected areas does not constitute a comprehensive property assessment. If your findings or other conditions give you reason for concern, additional sampling or evaluation by an appropriately qualified professional may be appropriate.

9. Insurance Claims

Some insurance policies or smoke-damage claims may provide coverage for necessary testing and sampling.

AfterFire Test does not determine insurance eligibility and cannot guarantee that any purchase will be covered or reimbursed by an insurer.

If you plan to seek reimbursement, retain your order receipt and laboratory results and contact your insurer regarding its coverage and documentation requirements.

10. Turnaround Times

Results are generally provided within 5 business days after the laboratory receives an acceptable sample.

Business days do not include weekends or laboratory holidays.

Sample collection issues, recollection, shipping delays, circumstances requiring additional laboratory review, laboratory workload, weather, equipment issues, or other circumstances outside our reasonable control may extend the turnaround time.

11. Shipping

Where a prepaid shipping label is included, it is intended solely for submission of samples associated with the applicable AfterFire Test order.

You are responsible for packaging, labeling, and submitting samples in accordance with the supplied instructions.

If additional shipping, handling, reshipping, or related charges are incurred because provided instructions were not followed or because shipment information supplied by the customer was incorrect, the customer may be responsible for those additional charges.

AfterFire Test is not responsible for carrier delays, lost or misdirected packages, weather-related delays, service interruptions, or other circumstances outside our reasonable control, except to the extent required by applicable law.

If a sample sent using an AfterFire Test prepaid shipping label appears to be lost or significantly delayed, please contact us so the shipment and available options can be reviewed.

12. Samples That Cannot Be Analyzed

A laboratory may be unable to analyze a sample because of insufficient material, improper collection, contamination, damage, incorrect packaging, missing identification, safety concerns, or another condition affecting the sample.

If resampling is required because of a customer collection, labeling, packaging, or submission issue, additional shipping, handling, or laboratory charges may apply.

If AfterFire Test or its laboratory partner is unable to provide the purchased testing for reasons not caused by the customer, AfterFire Test will, as appropriate, provide replacement testing, resampling, a credit, or a refund.

13. Hazardous or Inappropriate Samples

Do not intentionally submit hazardous, explosive, radioactive, infectious, corrosive, or otherwise dangerous materials unless AfterFire Test has expressly authorized the submission in advance.

You are responsible for disclosing any known or suspected hazard associated with a submitted sample. AfterFire Test or the laboratory may reject, dispose of, return, or decline to analyze a sample that poses a safety, regulatory, shipping, or handling concern.

14. Cancellations and Refunds

Orders may be canceled within 30 days of purchase only if no sample associated with the order has been shipped to the laboratory.

A sample is considered shipped once it has been tendered to the shipping carrier, including when an AfterFire Test prepaid shipping label has been scanned by the carrier.

Once any sample associated with an order has been shipped, the testing service is considered to have begun and the order is no longer eligible for cancellation or refund. This applies even if the sample has not yet arrived at the laboratory or laboratory analysis has not yet begun or been completed.

A minimum $25 cancellation and processing charge will be deducted from any approved cancellation refund. If nonrecoverable shipping, carrier, handling, or other order-specific costs already incurred exceed $25, the amount deducted may be higher to reflect those costs, to the extent permitted by applicable law.

For a multiple-location test, shipment of any sample associated with the order ends cancellation and refund eligibility for the bundled order. Unused sample locations are not eligible for a partial refund after any sample associated with that order has been shipped.

Expanded Dust & Particle Profile — Add-On may be changed or removed before any sample associated with the order has been shipped, subject to order-processing limitations. Once any sample associated with the order has been shipped, charges for the add-on are non-refundable.

The minimum cancellation charge does not apply to a refund issued because AfterFire Test or its laboratory partner is unable to provide the purchased testing for reasons not caused by the customer.

Nothing in these Terms limits any refund, cancellation, or consumer right that cannot legally be waived.

15. Prices and Payment

Prices shown at the time of purchase govern the order unless an obvious pricing or technical error has occurred. Payment is due at checkout.

AfterFire Test may change prices, product configurations, shipping arrangements, or available services for future orders at any time. Such changes will not retroactively alter a completed purchase unless agreed to by the customer.

16. Accuracy of Customer Information

You agree to provide accurate and complete contact, billing, shipping, property, and sample information.

AfterFire Test is not responsible for delays, lost communications, shipment problems, incorrect identification, or other issues resulting from inaccurate or incomplete information provided by the customer.

17. Electronic Communications

By placing an order, you consent to receiving communications reasonably necessary to complete your purchase and testing service, including order confirmations, sampling instructions, shipping information, status communications, and laboratory results.

You are responsible for providing a working email address and reviewing communications relating to your order.

18. Privacy and Confidentiality

AfterFire Test handles customer information in accordance with its Privacy Policy.

Information may be shared with laboratories, shipping carriers, payment processors, technology providers, and other service providers to the extent reasonably necessary to process and fulfill your order.

Information may also be disclosed where required by law, subpoena, court order, governmental authority, or other legally binding process.

19. Disclaimer of Warranties

AfterFire Test will use reasonable care in coordinating the services purchased. However, to the fullest extent permitted by applicable law, the services, website, instructions, reports, and related information are provided without warranties beyond those expressly stated in these Terms.

AfterFire Test does not warrant or guarantee that a sample is representative of an entire property, that every relevant substance or condition will be detected, that a particular result will be obtained, that testing will identify the source of detected material, or that results will satisfy the requirements of an insurer, regulator, court, landlord, buyer, seller, remediation company, healthcare provider, or other third party.

20. Limitation of Liability

AfterFire Test provides laboratory testing information and is not an insurer or guarantor against property damage, contamination, economic loss, health effects, remediation expenses, insurance disputes, or other losses.

To the fullest extent permitted by applicable law, AfterFire Test and its owners, employees, contractors, affiliates, laboratories, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the services, including loss of use, lost profits, loss of property value, loss of business, relocation expenses, remediation expenses, resampling expenses, loss of goodwill, or decisions made in reliance upon or interpretation of testing results.

AfterFire Test is not responsible for the purpose for which a customer or third party chooses to use, interpret, present, or rely upon test results.

To the fullest extent permitted by applicable law, the aggregate liability of AfterFire Test arising from or relating to a particular order, regardless of the legal theory asserted, will not exceed the amount actually paid to AfterFire Test for that order.

Nothing in these Terms excludes or limits liability that applicable law does not permit AfterFire Test to exclude or limit.

21. Decisions Based on Results

You remain responsible for decisions made based upon laboratory findings.

Before undertaking substantial remediation, reconstruction, relocation, litigation, a property transaction, medical action, or another significant decision based on testing results, consider whether additional inspection, sampling, professional evaluation, or expert advice is appropriate.

22. Third-Party Services

AfterFire Test may use independent laboratories, shipping carriers, payment processors, website providers, and other third-party providers in connection with the services.

AfterFire Test is not responsible for acts, omissions, interruptions, delays, or failures of independent third parties outside its reasonable control, except as required by applicable law.

Nothing on the AfterFire Test website should be interpreted as an endorsement by any governmental agency, laboratory, insurer, carrier, or other third party unless expressly stated.

23. Intellectual Property

The AfterFire Test name, website content, graphics, instructions, explanatory materials, and other proprietary content are owned by AfterFire Test or used with permission.

You may use materials provided with your purchase for personal use in connection with your order. You may also share your own laboratory results, receipts, and order documentation with physicians, insurers, contractors, attorneys, property professionals, or others assisting you.

You may not reproduce, sell, republish, or commercially exploit AfterFire Test proprietary website or instructional materials without written permission.

24. Events Outside Our Control

AfterFire Test will not be liable for delays or inability to perform caused by circumstances outside its reasonable control, including severe weather, wildfire, natural disaster, carrier disruption, governmental action, labor disputes, power or telecommunications failure, laboratory interruption, equipment failure, public emergency, or similar events.

We will make reasonable efforts to resume or complete affected services when practical.

25. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.

Nothing in these Terms limits rights you may have under mandatory federal, state, or local consumer-protection law.

26. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.

27. Changes to These Terms

AfterFire Test may update these Terms from time to time. The Terms in effect when you place your order will generally govern that order unless a change is required by law or otherwise agreed to by you.

28. Contact

If you have questions about these Terms, an order, a cancellation request, or shipping, please use the Contact Form on AfterFireTest.com and include your order number when applicable.
